These Terms of Service ("Terms") govern your access to and use of the ScoutQuiz AI Product Finder service ("Service") operated by ScoutQuiz AI Ltd ("ScoutQuiz", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms.
You must be at least 18 years old and have the authority to bind a business entity to these Terms. By using ScoutQuiz, you represent that you meet these requirements. The Service is intended for merchants operating e-commerce stores and is not for consumer personal use.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at [email protected] if you suspect unauthorized access to your account. We reserve the right to suspend accounts that violate these Terms or are used for fraudulent activity.
You may not share your account credentials with third parties or allow unauthorized individuals to access the Service using your credentials.
ScoutQuiz offers a free Starter plan and paid subscription plans (Growth, Pro). Paid plans are billed monthly or annually in advance. All prices are listed in USD and exclude applicable taxes.
Your subscription renews automatically at the end of each billing period. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current paid period. No refunds are issued for unused portions of a billing period, except where required by applicable law.
We may update pricing with 30 days' advance notice to active subscribers.
You agree not to use the Service to:
- Index or process content that violates applicable law or third-party rights
- Attempt to reverse-engineer, scrape, or extract ScoutQuiz's proprietary algorithms or models
- Use the Service to generate spam, phishing content, or misleading product descriptions
- Circumvent account or usage limits through technical means
- Resell or sublicense access to the Service without our written permission
- Use the Service in any way that could damage, disable, or impair ScoutQuiz infrastructure
We reserve the right to suspend or terminate accounts in violation of these terms without prior notice.
ScoutQuiz and its underlying technology, algorithms, and software are the intellectual property of ScoutQuiz AI Ltd and are protected by applicable IP laws.
Your product catalog data remains your property at all times. By connecting your store, you grant ScoutQuiz a limited, non-exclusive license to access and process your catalog data solely to provide the Service to you.
You may not copy, reproduce, distribute, or create derivative works from ScoutQuiz's software, UI, or documentation without explicit written permission.
We strive for 99.5% monthly uptime for the widget API. Scheduled maintenance windows will be announced in advance. We are not responsible for downtime caused by third-party services (Shopify, cloud infrastructure providers) or events outside our control (force majeure).
Pro plan customers receive an SLA with credits for downtime below the guaranteed threshold. See your Pro agreement for details.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT RECOMMENDATIONS WILL ACHIEVE ANY SPECIFIC BUSINESS OUTCOME.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCOUTQUIZ'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SCOUTQUIZ IN THE 12 MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL SCOUTQUIZ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY.
You agree to indemnify and hold ScoutQuiz, its officers, directors, employees, and contractors harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in London, UK, under the rules of the London Court of International Arbitration (LCIA).
We may modify these Terms at any time. Material changes will be communicated by email to registered users at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use and cancel your subscription.
